FTC requires manufacturers of CBD products to provide documents confirming their therapeutic properties
Ukraine is considered as a stock country, where biological waste is collected from around the world and using the worldwide excitement around the therapeutic properties of drug-free cannabinoids of this kind, products of this kind are sold at an inadequate price to the Ukrainian consumer. On the other hand, the lack of a regulatory framework does not allow people in need to cultivate plants with tremendous therapeutic properties, the cultivation of which is an absolutely socially safe measure, for example, therapeutic hemp.
On the pages of the profile electronic publication of Ukrainian hemp breeders , incidents of state structures of the USA , Great Britain , as well as other countries related to the mismatch of marking / description of CBD products with their real therapeutic capabilities have already been described more than once . The focus was on “ Why the FDA doubts the therapeutic properties of cannabidiol extract ”, for what reasons “The FDA requires removing the mention of therapeutic properties from products of another manufacturer of CBD products". In the USA, federal authorities are already becoming the norm for various products that include cannabidiol and claims on their part that the information on the package, as well as data disseminated about the “miracle drugs” that include drug-free cannabinoids, are not no grounds (in particular, official documents confirming their therapeutic properties).
In connection with the foregoing, it is necessary to focus on the fact that last week the Federal Trade Commission (FTC) sent regular official warning letters to enterprises working with CBD products. Warnings were sent to several hemp companies specializing in the production / sale of CBD products, which the US federal government criticized for:
• posting on the websites of companies that cannabidiol (CBD / CBD) "works like a magic tool";
• advertising CBD as a “miracle painkiller”;
• advertising the ability of CBD cream to relieve arthritis pain;
• using information that “clinically proven that CBD helps in the treatment of cancer, Alzheimer's disease, multiple sclerosis, fibromyalgia, cigarette dependence and colitis.”
Companies have been given 15 days to review all claims and document the therapeutic potential of cannabidiol by providing well-formed scientific evidence regarding the above issues.
What conclusions do American market analysts draw from the fact that FTC letters were distributed to companies specializing in the sale of cannabidiol-rich products:
1. US government agencies are closely monitoring to ensure that business entities specializing in working with CBD provide reliable information and do not allow the facts of "fraudulent business practices."
2. FTC officials are much less energetic than their FDA counterparts when it comes to cannabinoid products. Most likely, the passivity at the initial stage should be compensated by further active work in this direction, which implies the emergence of a wave of new letters requiring official clarification of the facts on which state officials have doubts.
3. The warnings sent by the FDA, and now the FTC, show the increased interest of government officials in the nascent CBD industry in the United States.
4. Marketing specialists of companies specializing in working with CBD products should regularly monitor information on these issues from government officials in order to make these recommendations / clarifications as practical as possible.
5. Companies that received relevant letters from government departments should respond as quickly as possible to them. If necessary, provide all the documentation available on this issue or remove inconsistencies found by government officials. Otherwise, the company may incur serious financial costs or lose the ability to market its products.
Commentary of the Ukrainian Technical Hemp Association
The Federal Trade Commission is an independent agency of the US government designed to protect consumer rights and, in particular, to monitor compliance with antitrust laws. Since its inception, the commission has been monitoring compliance with US antitrust laws. Like the U.S. Food and Drug Administration (FDA), the FTC may fine companies that provide false information about their products or prohibit their sale in the country.
The dominance in the Ukrainian market of low-grade “CBD products” made from Chinese synthetic cannabidiol and the absence of any reaction to this from the government of our country speaks only about one thing. Also, as in other markets, Ukraine is considered as a stock country, where biological waste is collected from around the world and using the worldwide excitement around the therapeutic properties of drug-free cannabinoids of this kind, products are sold at an inadequate price to the Ukrainian consumer. On the other hand, the lack of a regulatory framework does not allow people in need to cultivate plants with tremendous therapeutic properties, the cultivation of which is an absolutely socially safe measure, for example, therapeutic hemp.
