US FDA to be reviewed due to inaction on hemp as well as plant-based cannabidiol
The US FDA Commissioner will have to appear before the
House Oversight Committee of the US Congress for a thorough debriefing over the
lack of action regarding the regulation of hemp-derived cannabidiol.
According to a number of representatives of the lower house of the
US Congress, technical hemp has been legal at the federal level since 2018, but
FDA officials are in no hurry to regulate the legality of the production and
sale of products (food, cosmetics, various supplements) rich in natural cannabidiol , obtained from the hemp plant. Excuses from officials of the Office
about the need to collect more qualitative and voluminous data testifying to
the properties of non-narcotic cannabinoids {primarily cannabidiol (CBD)}
ceased to satisfy congressmen. In their opinion, “it has been several years,
and the industry is still waiting for clear rules that should rid the market of
unreliable entrepreneurs. However, it's not just about pleasing American hemp
companies. The lack of a proper regulatory framework also extends to issues of
consumer trust and safety.”
For example, Rep. James Comer (Chairman of the House Oversight
Committee of the US House of Representatives) announced his intention to
investigate the FDA for its inaction on critical issues that fall under the
FDA's regulatory jurisdiction, including hemp and its derivatives. , primarily
plant-derived cannabidiol. He expressed his intention to bring the Commissioner
of the Food and Drug Administration ( Food and drug Administration , FDA) to a
committee chaired by him, where the latter will have to appear before
congressmen for the most thorough questioning about the lack of action
regarding the regulation of hemp-derived cannabidiol.
In addition, in an interview published in the media, Mr. Comer
emphasized that “It's not just their lack of action on CBD and other cannabis.
This inactivity is evident in many areas of their jurisdiction ... We have an
Office with a big budget, they have a lot of staff, but they don't seem to be
doing much of their work, so there is a huge backlog in this matter.” According
to the congressman, it is necessary to focus on the problems that prevent the
FDA from fulfilling its functional duties and "try to put them on the
right track."
Commentary of the specialists of the Association “Ukrainian
Industrial Hemp”
It must be understood that before being elected to the US
Congress, James Comer served as Commissioner of Agriculture for Kentucky, one
of the key American states that specialize in the cultivation and processing of
hemp. Undoubtedly, Mr. Comer 's initiative will be welcomed by American
cannabis growers, who are actively raising the issue of legal uncertainty on
this issue and the threats that do not allow a full-scale "launch" of
the country's modern cannabis segment associated with the use of drug-free cannabinoids
in the industrial field .
I would like to pay special attention to the attitude of representatives of the US legislative branch to the responsibility of government officials for inaction, which leads to stagnation in certain segments of the country's cannabis industry, as well as the lack of a proper regulatory framework that guarantees the safety of consumers of CBD products. They are not satisfied with general phrases that the issue needs to be carefully studied. Responsible persons are summoned to the relevant committee and raise the question of the need to amend departmental regulatory documents. To our regret, the issue of regulating the possibility of using natural CBD for industrial purposes ( food , cosmetics , various additives , etc.) The country's modern cannabis industry has been rapidly developing over the past five years outside of any sane legal framework.
